Acceptable Use Policy

The rules governing permitted and prohibited uses of the doohthis platform.

Overview

This Acceptable Use Policy (the "AUP") governs your access to and use of the websites, software, applications, APIs and other services made available by doohthis, Inc. ("doohthis," "we," "us" or "our") (the "Services"). This AUP is incorporated into the doohthis Platform Terms of Use and applies to everyone who accesses or uses the Services, including customers, authorized users, trial and free users, and website visitors. Where a separate written agreement between you or your organization and doohthis (a "Customer Agreement") applies, that agreement governs to the extent of any conflict.

Capitalized terms used but not defined in this AUP have the meanings given in the applicable Customer Agreement or the Platform Terms of Use.

You are responsible for your use of the Services and for the acts and omissions of anyone who accesses the Services through your account, systems or credentials. You must ensure that your users comply with this AUP.

1. General Principles

You may use the Services only for lawful business purposes, in accordance with the Services' documentation and applicable agreements, and in compliance with all applicable laws. You must not use the Services in any way that is unlawful, harmful, deceptive, abusive, or that infringes or misappropriates the rights of others.

2. Prohibited Activities

You will not, and will not permit any authorized user or third party to:

2.1 Platform Security and Integrity

  • circumvent, disable or interfere with authentication, rate limits, credits, usage controls, security measures, or other technical restrictions or safeguards;
  • access or attempt to access accounts, data, systems or networks without authorization;
  • introduce or transmit malware, viruses or other harmful code, or conduct penetration testing, vulnerability scanning or load testing without our prior written authorization;
  • take any action that imposes an unreasonable or disproportionately large load on, or that could disrupt, degrade or impair, the Services or the systems or networks of doohthis or any third party; or
  • publish or disclose benchmark, performance or vulnerability-testing results relating to the Services without our prior written consent.

2.2 Intellectual Property and Reverse Engineering

  • copy, modify, translate or create derivative works of the Services except as expressly permitted;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover source code, underlying models, prompts, algorithms, weights or non-public APIs, except to the limited extent this restriction is prohibited by applicable law;
  • scrape, crawl, harvest, systematically extract, bulk download, or create a substitute or derivative database from the Services or any data made available through them;
  • use the Services, their outputs, documentation or other doohthis materials to develop, train, test, benchmark or improve a competing product, service or model; or
  • sell, resell, license, sublicense, distribute, rent, lease, timeshare or otherwise make the Services available to any third party except as expressly permitted.

2.3 Data and Contact Information

  • use contact, firmographic or other data made available through the Services other than for lawful business purposes and in accordance with applicable privacy, marketing and data-provider restrictions;
  • contact individuals who have opted out, whose contact is prohibited by law, or whose information was unlawfully obtained;
  • fail to honor applicable suppression lists, opt-outs or do-not-contact requirements; or
  • extract, resell, redistribute or publish third-party data, or use it to build a competing database, product or service.

2.4 Communications and Anti-Spam

  • send unsolicited, deceptive, or unlawful commercial communications, or otherwise violate the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), or other laws applicable to electronic communications, calling or texting;
  • use false, misleading or forged sender, header, routing or subject information;
  • omit required disclosures, a valid physical postal address, or a functioning unsubscribe or opt-out mechanism, or fail to honor opt-out requests within the period required by law; or
  • use the Services to send communications for which you do not have a valid legal basis or required consent.

2.5 Voice Features, Call Recording and Transcription

  • deploy voice, call-recording, transcription, artificial or prerecorded voice, or AI-generated voice features without complying with all applicable laws, including call-recording, wiretapping, consent, telemarketing, AI-disclosure and privacy laws;
  • record, transcribe or process calls without providing legally required notices and obtaining any required consent;
  • use voice features for outbound calling, telemarketing, autodialing, or prerecorded or AI-generated voice campaigns without our prior written approval and evidence of legally sufficient consent and compliance procedures; or
  • use voice features for emergency services, medical advice, crisis response, dispatch of emergency personnel, or any use where failure or delay could result in death, personal injury or material property damage.

2.6 Artificial Intelligence and Outputs

  • use the Services or their outputs to impersonate any person or entity without authority, or to create deceptive or misleading synthetic media;
  • use the Services to unlawfully discriminate, to make prohibited automated decisions, or to make consequential decisions about individuals (such as employment, credit, housing or insurance) in a manner that violates applicable law;
  • rely on outputs as the sole basis for a material decision without independent human review and verification; or
  • use the Services or their outputs to facilitate fraud, violate publicity or personality rights, or evade legally required disclosures.

2.7 Content and Representations

  • upload, transmit or generate content that is unlawful, infringing, defamatory, harassing, obscene, discriminatory or otherwise objectionable;
  • make false, misleading or unsubstantiated claims, or violate advertising, competition or consumer-protection laws; or
  • misrepresent your identity, affiliation or authority, or the source, pricing or availability of any inventory, product or service.

2.8 Unlawful and Unauthorized Use

  • use the Services in violation of any applicable law or regulation, including export-control, sanctions and anti-bribery laws;
  • use the Services in or for the benefit of an embargoed jurisdiction, a sanctioned person, or a prohibited end use; or
  • access or use the Services after suspension or termination, except for an expressly permitted data-export period.

3. Sensitive Data

You must not submit to the Services social-security numbers, payment-card data, health information, biometric identifiers, precise consumer geolocation, or other specially regulated or highly sensitive information, unless we have expressly approved that category of data in writing.

4. Your Responsibility and Compliance

You are solely responsible for your communications, contacts, content, offers, claims, prices and availability, and for the legal basis and consents required for your use of the Services. You must maintain the rights, licenses, notices, consents and lawful bases necessary for your use, and for doohthis to process your data as contemplated by the applicable agreement.

5. Enforcement

We may investigate suspected violations of this AUP and may restrict, suspend or terminate access to all or part of the Services where we reasonably believe your use violates this AUP or applicable law, creates a security, legal, deliverability, reputational or operational risk, or is required by a third-party provider or by law. Where practicable, we will seek to limit any suspension to the affected functionality and to provide notice, but we may act immediately where necessary to prevent harm.

We may also remove or disable content or functionality, require evidence of consent or lawful basis before restoring access, and report unlawful activity to law enforcement or other authorities. Our enforcement rights are in addition to any rights and remedies under the applicable Customer Agreement or the Platform Terms of Use.

7. Changes to This AUP

We may update this AUP from time to time to reflect changes in our Services, technology, or legal or regulatory requirements. When we do, we will revise the "Last Updated" date above. Your continued use of the Services after an update takes effect constitutes acceptance of the revised AUP.
